JAMMU: Dr Rubaiya Sayeed, daughter of former Chief Minister Mufti Muhammad Sayeed will appear before CBI court in Jammu on Friday as a witness in the case of her kidnapping in December 1989. The Central Bureau of Investigation (CBI) Court in Jammu had issued summons to Rubaiya Sayeed on May 28 this year to appear before the court in connection with this case.
Rubaiya Sayeed who is sister of PDP Chief Mehbooba Mufti, has landed in Jammu today for appearing in case on Friday.
On May 28, 2022, CBI court had issued summons to Rubaiya Sayeed, daughter of former Chief Minister Mufti Mohammed Sayeed, to appear before the Court on July 15 in a case wherein Special Judge TADA Court framed charges under sections 364, 368, 120-B of RPC, Section 3/4 of TADA Act, 1987 and Section 7/27 of Indian Arms Act against JKLF Chief Yasin Malik & others.
This was the first time that Rubaiya Sayeed was asked to appear in the case. She had been freed after five terrorists were released in exchange. Dr Rubaiya Sayeed, who stays in Tamil Nadu, is listed as a prosecution witness by CBI which took over the investigations into case in early 1990.
As per brief details, Yasin Malik, Chief of banned JKLF who has recently been sentenced to life imprisonment in a terror funding case, is an accused in Rubaiya Sayeed kidnapping case. While framing the charges, TADA Court observed that Yasin Malik along with other accused, in the first week of December 1989, entered into a criminal conspiracy to kidnap Dr Rubaiya Sayeed, who at that time was undergoing Resident Rotatory Internship Training in Lal Ded Hospital Srinagar and wrongfully confined her with ulterior motive of getting released five terrorists namely Hamid Sheikh, Altaf Ahmed Bhat, Noor Mohd Kalwal, Javed Ahmed Zarger and Sher Khan of JKLF, lodged in different jails, in exchange of her release. In furtherance of afore delineated criminal conspiracy, on December 8, 1989, Yasin and other accused namely Mohd Rafiq Dar, Ali Mohd Mir, Iqbal Ahmed Gandroo, Mushtaq Ahmed Lone, Manzoor Ahmed Sofi, Wahajat Bashir, Miraj-ud-din Sheikh ,Shoukat Ahmed Bakshi, Javed Ahmed alias Nalka, Nanaji alias Saleem, Riaz Ahmed Bhat, Khurshid Ahmed Dar, Basharat Rehman, Tariq Ashraf, Shafaqat Ahmed Shangloo and Manzoor Ahmed alias Muna alias Manzoor Islam assembled in house Mushtaq Ahmed Lone and deliberated upon plan to kidnap Dr Rubaiya Sayeed, when she would be returning for her house from Lal Ded Hospital Srinagar to Nowgoan Bye pass, Srinagar. Then, accused Javed Ahmed Mir alias Nalka entered a Mini Bus and forced Dr Rubaiya Sayeed to get down from the same and sit in blue-colored Maruti Car, driven by accused Ali Mohd Mir. Dr Rubaiya Sayeed was then taken to Sopore and kept in an old house situated in Irrigation Colony in possession of accused Javed Ahmed Mir. After two hours, she was shifted to Flat-B-1 of Irrigation Colony Sopore, belonging to accused Javed Ahmed Mir, where she remained from evening of December 8 to December 9, 1989. During entire period of confinement, accused namely Mohd Rafiq Dar and Iqbal Ahmed Gandroo, armed with AK-47 rifles along with accused Halima kept watch on Dr Rubaiya Sayeed, till her release on December 13, 1989 in exchange of JKLF terrorists.
