DB stays judgment of Writ Court, allows JKSSB to proceed with selection process of JEs, SIs

JAMMU: In an appeal filed by Jammu & Kashmir Service Selection Board against judgment of writ Court whereby Writ Court quashed exams of JE and SI being conducted by JKSSB, a Division Bench of Jammu & Kashmir and Ladakh High Court Comprising Justice Sindu Sharma and Justice Vinod Chatterji Koul after hearing Advocate General D C Raina with Deputy AG Rahul Sharma, stayed impugned judgment passed by Writ Court and directed Jammu & Kashmir Service Selection Board to proceed with selection process of Junior Engineer (Jal Shakti Department) and Sub-Inspector (Home Department), however, result of same shall await further orders from the Court.
CBT exam for SI posts from Dec 11-19 to be conducted as per schedule: JKSSB
JAMMU: The Jammu and Kashmir Service Selection Board (JKSSB) on Friday said that the Computer Based Written Test (CBT) examination for the post of Sub Inspector, Home Department which was scheduled to be held on December 9, 2022 will now be held on December 20, 2022 besides the examinations scheduled from December 11 to 19, 2022 shall be conducted as per the schedule.
A notice issued by Controller of Examinations, JKSSB in this regard reads, “It is hereby notified for the information of all such candidates whose Computer Based Written Test (CBT) examinations for the post of Sub Inspector Home Department advertised vide Notification no. 06 of 2021 which was scheduled on December 9, 2022 and was postponed vide Notice no.JKSSB-COE0EXAM (UT)/54/2022-03 (7057013) Dated: December 8, -2022 shall now be held on December 20, 2022”. The notice further reads that the Admit cards downloaded for the examination of December 9, 2022 by the candidates shall not be valid for examination on December 20, 2022 and the candidates need to download admit cards afresh for the CBT examination to be held on December 20, 2022. The Fresh Level 1 and Level 2 admit cards for the examination of December 20, 2022 shall remain available on JKSSB website w.e.f December 13 and 17, 2022 respectively, it adds.
“Further the examinations scheduled from December 11 to 19, 2022 shall be conducted as per the schedule issued already”, the notice reads.
During the course of hearing Advocate General submitted that in the present scenario, tenders are floated and offers are invited for highly complex technical subjects. It requires understanding and appreciation of the nature of work and the purpose it is going to serve. It is common knowledge in the competitive commercial field that technical bids pursuant to the notice inviting tenders are scrutinised by the technical experts and sometimes third-party assistance from those unconnected with the owner’s organisation is taken. This ensures objectivity. Bidder’s expertise and technical capability and capacity must be assessed by the experts. In the matters of financial assessment, consultants are appointed. It is because to check and ascertain that technical ability and the financial feasibility have sanguinity and are workable and realistic. There is a multi-prong complex approach; highly technical in nature. The tenders where public largesse is put to auction stand on a different compartment. DB observed that the contention of the Advocate General is that writ petition has been decided by Writ Court in contravention to Rule 14 and 15 of the writ proceeding rules and the entire selection process to the post of Junior Engineer (Jal Shakti Department) and Sub-Inspector (Home Department) have been quashed. Accordingly, DB stayed impugned judgment and ordered that JKSSB Shall proceed with the selection process of Junior Engineer (Jal Shakti Department) and Sub-Inspector (Home Department).
