DB directs Registrar General to furnish details of cases filed against non-residents of J&K, Ladakh

JAMMU: In a Public Interest Litigation, a Division Bench of Jammu & Kashmir High Court Srinagar Wing comprising Chief Justice (A) Rajesh Bindal and Justice Puneet Gupta, directed Registrar General of J&K Court to get details of all the civil and criminal cases filed against persons, who are not residents of Union Territories of J&K and Ladakh.
The significant direction has been passed in a petition filed by Bal Krishan, who prayed before the Court that he is being unnecessarily harassed after registration of FIR 69 of 2019 dated May 30, 2019 under Sections 420, 467 & 468 RPC at Police Station, Anantnag against him, though allegations made in the complaint are totally false.
In the petition, which is pending before the Single Bench of this Court, the issue raised by petitioner is that there are number of complaints filed against persons, who are not ordinarily residing in J&K and on that basis, FIRs have been registered. There are some cases filed in the courts also in form of complaints or civil suits seeking different reliefs. The object is merely to harass people and extract money from them.
It was further pointed out by counsel for petitioner in PIL that vide order dated October 18, 2019, the Registrar Vigilance of this Court was directed to find out details of cases registered against the persons, who are not residents Union Territory of J&K and have been implicated in criminal cases in South Kashmir. Though the report has been filed, but same mentions only criminal cases registered by police in four districts, namely, Anantnag, Pulwama, Shopian and Kulgam. The details are not forthcoming with reference to the civil or criminal cases filed in different courts in the aforesaid districts. Upon this Division Bench directed Registrar General of this Court may get details of all civil and criminal cases filed against the persons who are not residents of Union Territories of J&K and Ladakh.
