DB directives in PIL regarding illegal religious structures on encroached public land

JAMMU: In a suo-moto Public Interest Litigation (PIL) regarding illegal religious structures came up by way of encroachment on public land i.e public streets, public parks and public places in which a Division Bench of Jammu & Kashmir and Ladakh High Court Comprising Chief Justice N. Kotishwar Singh and Justice Moksha Khajuria Kazmi observed that this Court vide order dated 17th February 2023 granted four weeks’ time to S.S Nanda, Senior Additional Advocate General, for filing the report in terms of order dated 22nd December 2020 but the same has not been filed till date.
DB further observed that under the circumstances, we are constrained to direct that if the said report is not filed within a period of two weeks, a cost of Rs. 10,000 will be imposed on the concerned officer/official and the same will be recovered from the salary of the said concerned officer.
