DB denies permission to celebrate Ganesh Mahautsav at Parade Ground

JAMMU: A Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur on Monday dismissed the application seeking permission to celebrate Ganesh Mahautsav at Parade Ground Jammu.
The courts direction came in response to an application filed for seeking permission to celebrate annual Shri Ganesh Mahautsav at Parade Ground, Jammu from 17th to 27th September, 2015 as a special case. However, considering a Public Interest Litigation filed by Shambu Nath and others in which earlier Division Bench directed that Parade Ground should be used only for sports activities, the Division Bench after hearing senior Advocate Surinder Kour for the applicant and Advocate Aparjita Jamwal appearing for the PIL besides senior AAG S.S Nanda appearing for the State observed that by order dated 11th April, 2014 passed in Writ Petition and Public Interest Litigation, this Court considered the nature of the area where the applicant is seeking permission to celebrate Shri Ganesh Mahautsav as play ground and held that the play ground should not be used for any other purpose except sport activities and if there is any violation of the directions issued in PIL No.807/1998 dated 8th May 2002 and the directions issued on 11th November, 2014, the same shall be considered as contempt of Court and appropriate proceedings shall be initiated.
With the observations, Division Bench observed that in light of the final orders passed and having regard to the fact that the permission sought for is other than the sports activity, no direction can be issued. JNF
