JAMMU: In a much publicised Public Interest Litigation (PIL) filed against inaction on the part of State in implementing Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010, with the object of consolidating the law relating to the measurement, construction, control and management of works with respect to water storage, conservation, of the irrigation, water supply etc, today took a new turn when an application was filed by one Kali Dass seeking impleadment as party in the PIL.

In the application filed by one Kali Dass raised serious issues including that despite clear cut directions by this Court regarding ban on sale and construction on Khad, the Jammu Development Authority has invited applications for allotments of plots in three colonies namely Gole Gujral Housing Colony, Roop Nagar Housing Colony, Kot Bhalwal Housing Colony and the Birpur Housing Colony. The perusal of the advertisement dated July 15, 2014 clearly shows that the proposed sites are adjoining to the Nallahas and bank of River Tawi, the revenue record of the area Bhalwal and Birpur clearly shows that the nature of the land is marked as Gair Mumkin Khad in the revenue extracts.
Division Bench of State High Court comprising Justice Virender Singh and Justice Tashi Rabstan after hearing Advocate Abhinav Sharma for the PIL whereas Advocate Amit Gupta for the applicant Kali Dass, arrayed JDA as party respondent and issued notice to JDA through Vice-Chairperson/Secretary returnable within week.
Kali Dass also raised issues and said that directions have sought against the revenue agencies/ concerned bodies to regulate the free flow of the water channel so that the land from where there is natural flow of water should not be obstructed in any manner in the interest of General Public.
