Day-to-day proceeding in rape case against Uber driver

uber taxi rapeNew Delhi: A Delhi Court today said the criminal proceedings in the case relating to the of a 27-year-old woman executive allegdly by a driver of US-based cab service provider Uber will be conducted on day-to-day basis without any adjournment.

The court, which dubbed the matter as “sensitive”, also asked the Delhi Police to supply “deficient documents” including maps and photographs which were filed along with the charge sheet to accused Shiv Kumar Yadav’s advocate.

“It is a sensitive matter and it would go on a day-to-day basis. Hence, accused’s counsel should go through the documents quickly as no adjournment would be granted later,” Metropolitan Magistrate Ajay Kumar Malik said while supplying a copy of the 149-page charge sheet to Yadav’s counsel.

The court fixed January 5 for considering the charge sheet and asked Yadav’s lawyer to go through it in the courtroom itself.

“Accused given ample time for scrutiny of documents along with his counsel. It has been submitted by the counsel for the accused that in the charge sheet supplied to the accused, 10 photographs and six maps have not been supplied to him.

“Investigating Officer is directed to supply deficient documents to the accused on the next date of hearing. Matter be listed for January 5,” the court said, adding, that it will then order committal of the case to a sessions court.

Yadav’s judicial custody was also extended till Monday.

During the hearing in a packed courtroom where 32-year-old Yadav was produced with his face covered, his counsel Alok Dwivedi had asked for copies of 10 photographs and six maps of the route undertaken by the cab.

Yadav’s palm prints were also taken before another court after the police moved an application seeking permission for the same saying that the initial sample taken was “blur and inconclusive in the forensic report”.

After his palm prints were taken in the closed courtroom, he was produced again before Metropolitan Magistrate Ajay Kumar Malik where he was supplied the copy of the charge sheet and his counsel was asked to check and respond to it quickly.

Yadav, who was driving the cab, had allegedly raped the woman on the night of December 5 when the victim, who works for a finance company in Gurgaon, was headed back to her home in north Delhi’s Inderlok area.

The police had filed the charge sheet against Yadav on December 24, 19 days after the incident for alleged offences punishable under sections 376 (rape), 366 (kidnapping or abducting woman with an intent to compel her for marriage), 506 (criminal intimidation) and 323 (voluntarily causing hurt) under IPC.
