JAMMU: Third Additional Sessions Judge Jammu Kishore Kumar on Monday rejected the bail application of Sidharath Suri, son of Rajinder Kumar, resident of House No. 1007, Lower Mast Garh, Jammu a Cyber Café owner who was allegedly involved in rape case.
According to the police a report against the accused alleging of being raped by the accused, who is running a cyber café under the name and style of My Place at Kachi Chawni, Opposite Ranbir library. The victim used to visit the café for filling up forms, documents and scanning etc. Few months back, when she visited the café, accused forcibly raped her and took her nude photos and threatened to disclose the nude photos of the victim if she discloses incident of rape to anybody. He also took all documents and ATM card from the victim. Accused and his family members pressurized her parents for marriage. Though she had not disclosed the act of the accused to parents till her obscene photos were sent to her brother on mobile by the accused. On the receipt of this report, FIR NO. 197/2014 for the commission of offences under sections 376, 294 and 506 RPC was registered and investigation was commenced. After the completion of the investigation, offences under sections 376, 294, 292, 382, 506 and 354 RPC were prima facie proved against the accused.
Third Additional Sessions Judge Jammu Kishore Kumar after hearing both the sides observed that offences allegedly committed by the accused carry punishment of life imprisonment and serious in nature, it is considered to be a menace and threat to the society as a whole and the accused person, resorted to such activities which demean the psychological development of a woman.”
Court further observed that “The crime of rape is not only a crime against a person/or woman which it is a crime against the whole society. No doubt personal liberty guaranteed to the accused is undoubtedly his valuable right under Article 21 of the Constitution but the same can be refused to the accused in accordance with the procedure established under law. With these observations Court rejected the bail application.
