JAMMU: Railway Magistrate Jammu Sandeep Gandotra on Thursday returned the Challan presented in suicide case with the direction to SSP Jammu for further investigation.
While returning the Challan, the Railway Magistrate Jammu observed that investigation in this Challan was unprofessional and the suicide note was ignored.
As per Challan, Assistant Sub Inspector Mohammad Rafiq on 23rd February 2015 had recorded the statement of Deepak Kumar at GMC Jammu in which Kumar had stated that he was married to Simran about 9/10 years ago from whom he got divorced. Thereafter, he fell in love with a nurse working in Super Specialty Hospital Jammu and both of them agreed to marry. Deepak had gone to meet the nurse but she raised an alarm due to which he was shocked. Consequently, he went home and wrote a suicide note which was lying in his room. Later, he went to Tawi Bridge for committing suicide and jumped from the bridge receiving serious injuries. On this statement, FIR No. 36/2015 for offence under Section 309 RPC was registered against accused Deepak Kumar.
The Investigation Officer seized the suicide note of Deepak Kumar on 25th February 2015. Meanwhile, on 1st March 2015 Deepak Kumar succumbed to his injuries.
Considering that the most important piece of evidence with the Investigating Officer in this case was the ‘suicide note’ of the deceased Deepak Kumar. In the suicide note he has categorically written that the said nurse has cheated him. It was also written in the suicide note that she was in relationship with him since 2nd January 2014 and got pregnant by him on more than two occasions. He has also mentioned that he had stayed with her on many occasions in Meridian Hotel. “They stayed there for the first time at night on 10th January 2014”, the suicide note read. It was observed that investigating officer has totally ignored this note and not made any investigation from the person mentioned in this suicide note which prompted the deceased to commit suicide. It is important to note here that the deceased Deepak Kumar has categorically mentioned in his suicide note that the persons mentioned in the suicide note should not be let off after his death. The investigating officer has not enquired from the parents of the deceased, parents of nurse, employees of Super Specialty Hospital Jammu and employees of Hotel Meridian.
After considering the Challan, the Railway Magistrate Jammu observed that perusal of the Challan revealed that the investigation has been conducted by the investigating officer in most unprofessional manner and the SHO and SDPO City West have acted merely as rubber stamps and passed the Challan, ignoring the fact that a precious life has been lost.
Observing that investigation did not revealed that what prompted the deceased to commit suicide, the Court directed SSP Jammu for further investigation through any officer not below the rank of SP and submit the Challan within one month. JNF
