Court releases vehicle seized for extracting minerals from Tawi

JAMMU: A Division Bench of J&K State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan on Wednesday ordered release of vehicle being seized by the police for allegedly extracting minerals from river Tawi.
The Court ordered the release of vehicle, subject to deposit of Rs. 20,000 before Registrar Judicial, Jammu with an undertaking that the aforesaid vehicle was seized for the first time for the alleged violation and will not be used in future for such kind of violation.
The Court further observed that if the vehicle is seized for the second time for such kind of violation, it may take serious view of the matter and may not incline to release the vehicle.
Later, the Court made it clear that the Jurisdictional Court having received the challan should decide the same and the amount ordered to be deposited would be refunded in case the applicant is acquitted of the charges.
