Court rejects bail plea in rape case

Jammu: Third Additional Sessions Judge Jammu Haq Nawaz Zargar rejected the bail application of one Rajinder Kumar who was booked by the police under section 376/354/201 RPC.
According to the police case that on 6.2.2017 the victim filed a written complaint against the accused in Police Station, Woman Cell, Jammu.
In the complaint it has been stated that on 30.11.2016 when her husband had left for Hong Kong in connection with some sports activity, the accused who is a friend of her husband after dropping him at the Railway Station came to her house and molested her daughter under threat. He also took her objectionable pictures and threatened to make the picture viral if she told anybody. Thereafter, the accused tried to threaten her regularly. After the culmination of investigation on the basis of statements of witnesses recorded challan was produced.
Third Additional Sessions Judge Jammu Haq Nawaz Zargar after hearing both the sides observed that the charge has been framed against the accused u/s 376/354/201 RPC and till date no statement of any prosecution witness including prosecutrix has not been recorded. The aforesaid charges framed has not been altered and the same cannot be altered at this stage also. So prima facie presumption continues that accused had committed the offence. With these observations Court rejected the bail application. JNF
