JAMMU : The Special Mobile Magistrate Jammu Ashwani Kumar Sharma in his order has directed to file charge sheet against the accused through Police Station Peer Mitha, Jammu verses Aradhana Kumari and others. The case FIR 8/2013 for offences under section 420/120-B RPC was registered at Police Station Peer Mitha, Jammu
According to the resume of the facts the accused Aradhana Kumari wife of Rajesh Kumar created friendly relations with the family members of a retired MES Officer Tapeesh Datta and used to call him as her father and the complainant Tapeesh Datta also treated her as his daughter. The friendly relations continued for quite a long period. When she was fully convinced to have won the confidence of Tapeesh Datta, she approached the complainant and pleaded that she was in dire need of Rs 10 lakh and made a request that in lieu of this amount she would keep her gold ornaments with complainant as security and besides this she would pay an interest of Rs 25,000 per month.
Since harmonious relationship prevailed between both the parties, complainant paid her Rs 10 lakh in turn received gold ornaments weighing 481 grams. After receiving the said amount, the accused Aradhna Kumari paid interest at the rate of Rs 25,000 per month for seven months.
During eighth month the accused refused to pay the interest and instead asked the complainant to sell the gold ornaments and in case the cost of gold exceeds Rs 10 lakh, the excess amount be paid to her. Accordingly both the parties went to a particular Goldsmith Jawahar Jeweller where the accused with the assistance of conspirators picked up the gold ornaments and tried to flee.
Since she had managed to possess the ornaments, the complainant filed a case at Police Station Peer Mitha, Jammu. The Peer Mitha police registered the case FIR 8/2013 under section 420/120-B and produced the challan in the Court after completing inquiry.
The Court after going into the detail of the case including the footage of the CCTV camera held that the accused Aradhna Kumari, her husband Rajesh Kumar, Jawahar Jeweller and her accomplice Iftikhar Salaria are prima facie involved in the case, and they be chargesheeted. The next date of hearing has been fixed by the Court as 31st July.
