Court denies bail to narco smuggler

JAMMU: Additional Sessions Judge, Jammu Shahzad Azeem on Sunday rejected the bail application of alleged medical narco smuggler, Rajesh Dutta. Additional Public Prosecutor, Abdul Hafiz appearing for the State submitted that the accused was arrested in case FIR No. 190 of 2016, under Section 8/21/22 NDPS Act.
He further said the investigation in the aforesaid case is at initial stage and if the accused is enlarged on bail, he would try to tamper the evidence.
The Court observed that the menace of drug trafficking has drastically shoot up in the country, especially in the state of Jammu & Kashmir, for the last two decades and has swollen in its venomous ambit, the young generation of the nation and has seriously jeopardised the economy of the country. Hence, keeping in view the stage of investigation and bar of Section 37 of NDPS Act, exercise of discretion is fraught with danger and experience shows that the business of drugs in different form swallow each and every root and in order to achieve this nefarious design, the people have been involved in different capacities including carriers, transporters, consumers in this trade. With these observations, the Court rejected the bail application of the aforementioned accused.
