Court denies bail to four in gang rape case

JAMMU: Principal Sessions Judge Bhadarwah Bala Jyoti on Wednesday rejected the bail applications of four accused namely Mohammad Yousaf, Chandia, Noor Hussain and Mohammad Younus who were facing trial in a gang rape case.
According to prosecution, on the intervening night of 13/14 November 2013, the accused persons broke the bolt of house of prosecutrix who is a widow, when she was sleeping with her children. It was alleged that the four accused sexually abused her after covering eyes with a cloth besides tying her hands.
Justice Jyoti after hearing both sides observed that the prosecutrix happens to be a forty-year old married woman. Thus, it is highly unlikely that she would allege the offence of rape, that too of gang rape, merely to falsely implicate the petitioners. Therefore, the contention raised by the learned counsel is unacceptable. With these observations Court rejected the bail applications. JNF
