Court awards life imprisonment in murder case

RAJOURI: Principal Sessions Judge Rajouri Inder Singh in the murder case of one Tahir Khan, son of Mohammad Mushtaq and murderous attack on one Lubna Kouser, daughter of Mohammad Afzal on Wednesday awarded life imprisonment to one Imtiyaz Ahmed, son of Mohammad Ashraf, resident of Rajouri besides fine. The case was pleaded by Mukhtar Mirza Public Prosecutor for the State. According to the case, the accused Imtiyaz Ahmed with the intention to kill Tahir Khan , and his fiancée Lubna Kouser hit their motorcycle from behind by a vehicle at Rajouri in which both bike riders were seriously injured. The injured were shifted to Rajouri Hospital where Tahir Khan succumbed to injury and Lubna Kouser was referred to GMC Hospital Jammu. The accused fled from the spot with his vehicle and later repaired the vehicle to cause disappearance of evidence.
The police registered a case FIR 38/2012 under Section 307 RPC which was later converted to Section 302 RPC. The police seized the damaged motorcycle and also the Xylo Vehicle used for commissioning of offence and included an additional section 201 RPC in the FIR for destroying the evidence.
After thorough investigation it came to fore that the accused was interested to marry Lubna Kouser but the proposal was not matured and she got engaged with the deceased Tahir Khan.
The accused could not tolerate it and threatened to kill them. Consequently, he hit them when they were riding a bike on National Highway near Dhooda Dhari Mandir Rajouri.
While the counsel for the Defence Liaqat Ali pleaded his client as innocent, the Public Prosecutor for the State Mukhtar Mirza produced number of witnesses and succeeded to establish that the accused had intentionally hit the motorcycle of Tahir Khan in order to kill him and his fiancée.
In the light of evidence coming on record, the Principal Judge convicted the accused and awarded life imprisonment for commission of offence under section 302 RPC with a fine of Rs 50,000.
The Principal Judge also awarded him simple imprisonment of seven years and a fine of Rs 20,000 for the offence under Section 307 RPC and simple imprisonment of three years with a fine of Rs 10,000 for offence under Section 201 RPC. He also directed that the sentences will run concurrently.
