Court awards 15-year RI, Rs 50,000 fine to two in gang-rape case

JAMMU: Principal Sessions Judge Reasi R N Wattal awarded 15 years rigorous imprisonment and fine Rs 50,000 to Rinku Kumar and Kuldeep Kumar in a Gang Rape case. Court also recommended Rs 5 lakh compensation to victim in terms of victim compensation scheme for the victim.
According to case, on August 28, 2018, complainant in company of her mother Sushma Devi lodged a complaint addressed to IGP for registering an FIR against accused Sonu & Kuldeep, sons of Tara Chand; Rinku, son of Gopal Krishan, residents of Arli Hansali, Tehsil Katra, District Reasi and Rajkumar, son of Hari, resident of Tikri with the averments that the complainant was at her house and at about 11 PM, she went out to attend nature’s call. When she came out of house, all of a sudden she was caught hold, her mouth was closed, she was made to sit in a van that was parked at gate of her house. In the van, she identified accused, who took her to forests near Bhumika Temple, where accused Sonu tore her clothes, caught hold of her and raped her.
Principal Sessions Judge Reasi R N Wattal after hearing Public Prosecutor Ranjeet Kumar Gupta for the UT whereas Adv Ashok Sharma for the accused, observed that the nature of the offence committed by the accused plays an important role in awarding the punishment. “One of the principles that judiciary has to kept in mind is that rape being a violation with violence of private person of a women causes mental scar, thus not only physical injury but a deep sense of some deathlessness shape is also inflicted,” the Court observed and ordered that each accused is convicted for commission of the offences under sections 366 and 376D read with sections 109 and 34 of RPC and sentenced to undergo rigorous imprisonment of two years and fine of Rs 10,000 for the commission offence under section 366 of RPC, rigorous imprisonment of 15 years and fine of Rs 50,000 each for commission of offence under section 376D of RPC. Both sentences shall run concurrently.
