Constructions in Khad: JDA asked to file objection
JAMMU: In the much publicised Public Interest Litigation (PIL) filed against inaction on the part of the State in implementing the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010, with the object of consolidating the law relating to the measurement, construction, control and management of works with respect to water storage, conservation, of the irrigation, water supply etc in which one application filed by Kali Dass raised serious issues including that despite clear cut directions by this Court regarding ban on sale and construction on Khad, the Jammu Development Authority has invited applications for allotments of Plots in three colonies namely Gole Gujral Housing Colony, Roop Nagar Housing colony, Kot Bhalwal Housing Colony and the Bir-Pur Housing Colony.
The perusal of the advertisement dated 15th July, 2014 clearly shows that the proposed sites are adjoining to the Nallahas and bank of River Tawi, the revenue record of the area Bhalwal and Birpur clearly shows that the nature of the land is marked as Gair Mumkin Khad in the revenue extracts.
A Division Bench of State High Court Comprising Justice Virender Singh and Justice Dhiraj Singh Thakur after hearing battery of lawyers appearing for the both sides, granted week’s time to JDA for filling objections. JNF
