Charges framed in Udhampur petrol bomb attack case

JAMMU: Principal Sessions Judge Udhampur Rakesh Sagar Jain Friday framed charges in the Udhampur petrol mob attack case against Balbhadur Singh, Danish, Varinder Singh, Harish Katoch, Sunit Singh, Rahul Sharma, Sandoor Singh, Amit Singh, Rohit Sharma, Kuldeep Singh, Balram Singh alias Pankaj Singh and Raju Rameshwar Singh and Jasbir Singh and Vikas Sharma.
Prosecution had contended that the above accused gathered on the National Highway and were pelting stones on the vehicles injuring on Mohd Ismail who was travelling in a Innova (JK19/2649). On receipt of this report, police reached the spot and apprehended Bal Bhadur Singh whereas the others ran away. On receipt of the report, FIR No.367/2015 was registered in police station Udhampur and seized Innova. The statements of the witnesses and the injured were recorded.
During the investigation, it came out that the accused pelted stones on the vehicles going to Srinagar and damaged them and also damaged truck No. JK18/4094 going from Jammu to Srinagar by pelting stones on it and injured its driver Khursheed Ahmed Naik and Siar Ahmed were injured. As per the investigation, it came out that on 9.10.2015, certain accused at Sumbal road, Udhampur were present where they accused Rameshwar Singh on ‘Whats app’ of his mobile phone showed the accused the incident of cow slaughter at Chenani and instigated them that cow slaughter is taking place and a beef party is being held in Kashmir and the Hindus need to do something about it.
At Bharatnagar, NHW where the accused pelted stones on Kashmir bound vehicles and threw petrol bomb and damaged the vehicle and injured some drivers and passengers. The police arrested Balbhadur Singh was caught red handed on spot and other accused ran away from spot. Accused Danish was arrested and made a disclosure statement and thereafter recovered a petrol bomb from the link road, Subash Stadium. Accused Vikas Sharma harbored the accused and accused Jasbir Singh and Rameshwar Singh entering into a criminal conspiracy with the other accused got the offence committed.
Principal Sessions Judge Udhampur Rakesh Sagar Jain after hearing both the sides in length observed that on the basis of the material on record prima facie in shape of the facts of the case as emerging in the statements of the witnesses recorded by the investigating agency, there is sufficient material on record for framing charge against all the accused.
