JAMMU: The Crime Branch wing of the Jammu and Kashmir Police on Wednesday registered a case against a Jammu based contractor Kulbhushan Gupta, owner of Sansar Group of Industries for allegedly taking money from 65 to 70 buyers but not giving them possession of the flats constructed at posh Trikuta Nagar extension locality
According to Crime Branch, a written complaint lodged by the Association Florence Apartments through Harmeen Kour Soodan, wife of Pavandeep Singh Soodan, resident of H. No. 43/3 Nanak Nagar, Jammu stating that Ansal Buildwell Ltd. in partnership with Kulbhushan Gupta (Sansar Group of Industries), resident of 117-A/D, Gandhi Nagar, Jammu jointly launched multi-storey housing project on the name of Florence Apartments, Satyam Road, Trikuta Nagar Extension, Jammu in 2008 and allured the public at large to invest and purchase flats/commercial sites.
The complainants informed CB that they booked their flats as per prescribed price list and plan of payment but till date they have not been provided the legal possession of the flats/properties despite having made the payment since past five to seven years.
“That, the accused, even after receiving crores of rupees from the complainants have not completed the project and are finding ways and means to harass the complainants by threatening them through their paid musclemen and depriving them of their right to possession of their respective flats, in furtherance of a criminal conspiracy and in order to sell the flats to someone else on higher rates due to escalation of prices of real estate, as such, legal action may be initiated etc”, the complaint added.
On the receipt of this complaint, a preliminary verification was initiated by the Crime Branch, Jammu and during the course of verification it was found that accused Kulbushan Gupta, being the owner of the land and promoter of Florence Apartments had associated with Ansal Buildwell Ltd. in order to carry out the construction of residential/commercial towers but after alluring the prospective buyers and receiving crores of rupees from them had refused to provide them the legal possession of the properties through registration of the sale deeds.
It was further revealed that Ansal Buildwell Ltd had carried out the work smoothly and was ready to give possession to the buyers but it was the accused Kulbushan Gupta who created hindrances by deliberately and intentionally keeping the project incomplete as he wanted to sell the flats/properties to someone else on higher rates due to escalation of prices of real estate.
“It is because of his greed and ill intentions that he trapped the innocent buyers through allurements and now is finding ways and means to illegally dispossess the prospective buyers/owners by not giving them legal possessions and cancel the deals as some of the buyers/owners who already possess the keys of their incomplete flats are being threatened through his paid musclemen and goons to vacate the premises”, it was revealed.
“It also came to fore that accused Kulbushan Gupta has cheated and duped 65-70 aggrieved senior citizens of Jammu including the complainants, who are in dire need of accommodation, by continuously harassing and depriving them of their right to property on one or the other pretext and swindling crores of rupees by criminally misappropriating the same on his personal use”, they added.
After completion of investigations, the Crime Branch has registered FIR under section 420, 406 RPC against Kulbhushan Gupta.
