JAMMU: The Crime Branch, Jammu, on Tuesday, registered an FIR against a Tehsildar and others for mutation of land on the basis of non-existent sale deeds in sheer abuse of their official positions.
FIR under Sections 420,465,467,468,471,120-B RPC read with Sec. 5(2) Prevention of corruption C Act Svt. 2006 has been registered against Janak Singh, the then Patwari, resident of Kalyan Pora, Jammu and Subash Singh Chib, the then Tehsildar, Jammu for conferring pecuniary benefits upon themselves and having hatched a criminal conspiracy with accused Baldev Raj, son of Ami Chand, resident of Gole Talab Tillo, Jammu Ward No. 31, Gole Panj Pir and Sucha Singh, son of Sarwan Singh, resident of 22-B Bhawani Nagar, Jammu. In furtherance of the criminal conspiracy, the accused had fraudulently mutated 2 kanals of land of Lehna Singh and Teja Singh in favour of accused Baldev Raj on the basis of non-existent sale deeds in sheer abuse of their official positions.
According to FIR, a complaint lodged by Janak Singh, son of Raj Singh, resident of 9-A Bhagwati Nagar, Jammu and forwarded by Sub-Judge Special Excise Magistrate, Jammu was received in Crime Branch wherein the complainant had alleged that he was owner and in possession of land measuring one Kanal, falling in Khasra No. 164 min situated in Nawabad, Jammu which he had purchased from Lehna Singh and had appointed his brother namely Sarwan Singh, son of Late Raj Singh, resident of 22-B Bhawani Nagar, Jammu as the caretaker of the said land.
However, Sarwan Singh in connivance with his son Sucha Singh got the name of Sarwan Singh recorded in the Khasra Girdawari, in respect of the land, in furtherance of a criminal conspiracy and connivance of Sat Paul, the then Tehsildar, Jammu and Subash Sharma, the then Patwari Jammu, despite the fact that both Sarwan Singh and his son Sucha Singh were neither the owners nor had any revenue record in their name. It was further alleged that accused Sarwan Singh and Sucha Singh staked their claims on the basis of two sale deeds executed by Lehna Singh in favour of one Baldev Raj duly registered and the other executed by one Teja Singh brother of Lehna Singh in favour of the said Baldev Raj, duly registered before the court, but on ascertaining the records, no such sale deeds were found to have been executed or registered before any court. The accused had prepared fake and fabricated documents on the basis of which the revenue officials Sat Paul and Subash Sharma had recorded the entries and the mutations in sheer misuse of their official position in lieu of pecuniary benefits etc.
Acting on the complaint, Crime Branch, after investigation, register case against Baldev Raj, Sucha Singh, Janak Singh the then Patwari Halqa Nawabad (now retired), resident of Kalyanpur, Jammu and Subash Singh Chib, the then Tehsildar, Jammu, prima facie, constitute offences punishable under sections 420,465,467,468,471,120-B RPC read with Sec. 5(2) P.C Act Svt. 2006.
