CAT directs PSC to declare result of petitioner

JAMMU: The Central Administrative Tribunal (CAT) directed Jammu & Kashmir Public Service Commission to declare the result of J&K CCE of petitioner.
The petitioner Shalini chandel filed the petition Seeking quashing Impugned Notice dated 3.2.2022 whereby and where under the candidature of the applicant has been rejected for participating in J&K Combined Competitive (Main) Examiniation-2021 which is illegal, arbitrary, unjustified and also an abuse of process of law. Seeking to quash impugned Notice dated 28.2.2022 issued by respondent No. 2 whereby and where under appeal filed by the applicant against Notice dated 3.2.2022 has been rejected and the applicant has been declared ineligible on the ground that the applicant did not possess the domicile certificate before the cut-off date and the same is per se illegal and also directing the respondents to allow the applicant to participate in J&K Combined Competitive (Main) Examination – 2021 as advertised pursuant to Advertisement Notification No. PSC/Exam/2021/61 dated 26.11.2021.
CAT after hearing Advocates Rajneesh Singh Parihar and Akash Gupta for the petitioner, ordered that the impugned orders dated 03.02.2022 and dated 28.02.2022 with regard to candidature of the applicant are hereby quashed and set aside. The Jammu and Kashmir Public Service Commission, Jammu is directed to declare the result of the applicant and, if the applicant is found to be meritorious enough for being included in the merit list for consideration for appointment, she shall be so included in the merit list for the purpose of giving appointment. With the above directions, the Original application is allowed.
