Budgam sex scandal case DB issues show cause notice to counsel

JAMMU: In a much publicised acquittal in Budgam Sex Scandal which was stayed by the Division Bench and sent the accused behind bars, Division Bench (DB) of State High Court comprising Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey taking serious note on the statement made by a counsel issued show cause notice stating that why he should not be punished for having committed contempt of Court, that too in the face of court.
Court further directed that Advocate Mushtaq Ahmad Dar to further show cause as to why case should not be also referred to State Bar Council for considering suspension of his license.
It further directed Registry to frame Rule and serve copy of this order on Advocate Mushtaq, who was present in the court and also directed Registry to place the copy of this order before the State Bar Council.
The Division Bench informed Dar that his statement, ‘this is the state of affairs of our Judiciary in the State’ has effect of scandalisation and lowering downs the prestige of the Institution of Judiciary in the eyes of general public. It said that the counsel by his expressions and conduct showed inveterate defiance to the Court and stated the he may be proceeded against.
Division Bench further observed that counsel did not show any remorse of having used words and expressions which have the potential of lowering down prestige of the Court.
Division Bench further observed that Court is duty bound to protect the judges of the subordinate courts from being harassed and comments being made about their conduct in the discharging of their judicial functions. JNF
