BJP owes explanation to Drabu’s remark on J&K: Pawan

JAMMU: Terming the statement of Finance Minister Haseeb Drabu that J&K is a much larger issue, a constitutional issue which hasn’t been settled yet as sheer disrespect to the Constitutions of both India and J and K State, former Minister and MLA Udhampur Pawan Gupta on Friday said BJP, which is part and parcel of the State Government, owes answer to the Nation as to whether it stands for its ideology so opted since the time of 1952 for abrogation of Article 370 or it endorses the statement of Drabu purporting disputed status of the J&K State and challenging the constitutional validity of the J&K’s integration with Indian Union.
He said the Indian Independence Act 1947, authorized the accession of princely States by their respective rulers which on the same format was executed by the Maharaja on October 26th, 1947 and duly accepted by the Governor General of India unconditionally. Based on it the State became integral part of India under Article l of the Constitution of India as well as Article 370 also relying on the same Instrument of accession. “The J&K State became integral part of India again rectifying the Instrument of accession as per Preamble of State Constitution and its Section 3 further affirms that the J&K State is and shall remain integral part of India which is firm and is inalienable in terms of unanimous decision of the State Constituent Assembly”, the MLA further cited.
Pawan Gupta alleged that a constitutional functionary especially holding ministerial berth while issuing such irresponsible and antinational statements amount to trampling upon constitutional propriety while toeing with the view of Pakistani state. “The propriety demands his voluntarily resignation both from minister-ship and from Assembly seat in view of his statement completely in violation of the oath he subscribed to bear allegiance to the constitution while entering into his Office”, he maintained adding that BJP being ideologue of the PDP, should distance from such irresponsible and antinational statement of Drabu and in case it also endorses the same it becomes imperative for the Government of India to dismiss the present Coalition Government and impose Governor’s Rule by invoking Section 92 of the State Constitution to avoid further breach of constitutional functioning and letting the State functionaries to indulge in spreading separatists activities in the state.
He said that State BJP has already compromised by aligning with this secessionist arrangement and has put great harm to the sovereignty and integrity of the State and also by lowering the morals of patriotic forces. Gupta further questioned the State BJP as to how long the Jammu people, who mandated it, will be forced to bear the pangs of secession and regional imbalances at the hands of BJP further by being a mute spectator and becoming ally for damaging the interests of Jammu people and promoting antinational policies of the present regime.
