Big relief to poor as for 2.5 Marla plot JMC to give building permission on NOC, land title

JAMMU: In its general house meeting the Jammu Municipal Corporation (JMC) here on Friday unanimously passed building bylaws.
As a gift to the people of Jammu JMC has given a big relief for the poor as for 2.5 Marla plots, building permission shall be given on NOC and title of land.
Continuing with his another revolutionary step for the welfare of Jammu public, Mayor of Jammu city, Rajinder Sharma said that there should be only one Controlling and Supervisory Authority within the jurisdiction of JMC and JDA, Housing Board and Sainik Board should have no jurisdiction and whatever assets they will make should be controlled and supervised by JMC only.
He also said that as per the bylaws passed today, old Jammu city and some other selected places were declared core areas where even building permission shall be given even if the width of lanes is less than 10 ft.
“This shall double the value of houses in these areas as banks may easily lend loan for buying houses in these areas,” the Mayor said adding: “The areas within the JMC limits excluding Nallahs, forests and water bodies should be considered as constructed areas.”
He said that this new development will curb corruption in revenue department to a large extent.
Sharma further said when a Corporation is formed due to expansion of a city or urbanisation then agricultural land, Khad, Nehri etc titles naturally become meaningless.
“Also when people go for getting NOC in commercial areas, for example, if road has width of 40 ft in master plan at some commercial area but on ground it is only 30 ft, the applicant would never get NOC in core area. Now such NOCs shall be given on existing road width in core areas,” the Mayor continued adding that Core Area, Planned Area and To Be Developed Area shall be declared in the master plan.
He said that norms as per building bylaws followed by already constructed Houses will now get permission for further construction on charging money for the lower portion only.
If a house is constructed without building permission and the owner wants to increase the constructed area then for the area to be constructed building permission shall be given and for the already existing one the JMC shall charge for granting building permission but the owner of the house shall have to alter the portion which remains in violation of the bylaws.
“Only 25 per cent of the required fees has to be deposited showing title of the land for cases wherein the first permission was secured but construction not started while earlier whole fees was to be deposited and all the NOCs were to be obtained afresh,” he said.
He also said that while the (JMRDA) Jammu Metropolitan Regional Development Authority is taking cases of over 2 kanals and now cases of JMC shall be taken by JMC itself now.
“For (CLU) Change of Land Use cases JMC Act will be amended to further empower JMC to give CLU permission,” Sharma said.
He further said that for small shops no parking place is needed while for the big shops parking places is required.
“In case of commercial for the constructed area out of building permission, the owner shall have to pay security fee to JMC for removal but still he has to provide parking and this is for out of core area,” he maintained.
