JAMMU: Principal Sessions Judge Samba M.L Manhas on Tuesday rejected the bail applications of Shahbaz Mohi-Ud-Din, Mudassar Ahmed Bhat and Ishfaq Ahmed Ganai from whom police has recovered 18,400 capsules.
According to the police, the accused persons have been arrested in case vide FIR No. 02/2017 under Sections 8, 21 and 22 NDPS Act of Police Station Bari Brahmana for the allegations that 18,400 Spasmoproxy Van Spas Plus have been recovered from their possession.
Justice Manhas after hearing Public Prosecutor Bhupinder Singh Charak appearing for the State and Advocates Ganesh Sharma and Monika Kohli appearing for the accused persons, observed that Courts cannot lose sight of the fact that crime of smuggling of contraband drugs are on increase, and therefore, the perpetrators of the crime must be dealt with iron hands. The crime committed by applicants/accused is against the society and by their criminal activities they are spoiling the young generation of the country. Showing leniency in such matters would really be a case of misplaced sympathy. This is a fittest case where, “Jail” and not “Bail”, is the appropriate remedy. With these observations court rejected the bail application. JNF
