Bail rejected in rape case

JAMMU: Principal Sessions Judge Kathua Vinod Chatterji Koul rejected the bail application of Ganesh Singh, son of Narayan Singh, resident of Dadora, Tehsil and District Kathua who was allegedly involved in rape case.
Justice Koul after hearing both the sides observed that charge against the accused is that on 14th September 2016, he was hiding himself in the bushes and when the prosecutrix had gone outside his house and reached near the bushes, accused came out and threatened to kill her with a pistol. “Thereafter he took her towards bushes and committed rape upon her twice. Prior to the aforesaid incident about four months back, while the prosecutrix was coming to her house from school, accused had also committed rape upon her on gunpoint and also prepared her video. On 18th September 2016, when the prosecutrix had gone to fetch water at Bowli, accused intercepted her and tore off of her clothes”, the Court observed.
Court further observed that severity of the crime alleged to have been committed by the petitioner/accused, the supporting evidence and all other connected facts, do justify an inference that petitioner may misuse the concession of bail to escape the dragnet of law and once that possibility cannot be ruled out, the concession of bail cannot be extended. There are so many aggravating circumstances, which disentitle the petitioner/accused from claiming the concession of bail. With these observations Court rejected the bail application.
