JAMMU: Presiding Officer Fast Track Court Kishore Kumar Wednesday rejected the bail application of one Ghulam Hussain S/o Late Ghulam Mohd R/o Dedpeth, Kishtwar, District Kishtwar, as he was involved in rape case.
According to the police prosecutrix developed friendship with a boy namely Sunil Kumar telephonically whose mobile number was given to her by a girl of her locality about 1½ years ago. The accused no. 1 used to chat with her and she fell in love with him. One day, she was called by accused no. 1 at Bakshi Nagar to meet him and on reaching Bakshi Nagar Jammu, she found two boys sitting in a tempo, one of them disclosed his name as Sunil Kumar and the other as Ghulam Hussain. Thereafter, both of them forcibly got her seated in the tempo and took her towards Bus-Stand in an isolated place. Accused no. 1 Sunil Kumar disclosed her that his actual name is Fayaz Ahmed S/o Bashir Ahmed Khan R/o Dedpath, Kishtwar and caught hold and tried to molest her and on her resistance also assaulted her and told her that he is a married person. Thereafter, he left her in the vehicle along with Ghulam Hussain S/o Ghulam Mohd. Accused no. 2 took her to his sister’s house at Bantalab under threat and committed rape upon her and thereafter accused Ghulam Hussain left her at Bus Stand.
Court after hearing both the sides observed that crime against women, particularly, incident of rape of minor, the Courts have already sounded that precaution is to be taken while considering the bail pleas of the offender(s) of such heinous crime. It has been impressed upon the Judicial Officers and Sessions Judges dealing with such cases to take care and caution in exercising discretion to consider the release or otherwise of the accused on bail pending investigation and trial, lest the discretion so exercised affects adversely the societal interests, investigation and fair trial. With these observations Court rejected the bail application.
