Bail denied to cheater

JAMMU: Special Municipal Magistrate Jammu M R Chak Thursday rejected the bail application of one Venkata Krishna Modegula, who was arrested by the Crime Branch in much publicized rice puller case.
As per Crime Branch report, a written complaint was lodged by Raj Kumar Gupta of Gandhi Nagar mentioning that accused Venkata Krishna Modegula, D BalasubranayamTirupati, Gowhar Hussain Rather, Afroz Ahmed Khan, Mushtaq Ahmed, Sohail Ahmed Khan, Imtiaz Ahmed Khan, Bilqees Mir, Mohammad Maqbool Dar, Irfan Ul Hamid, Sheikh Irshad, Mohammad Ishtiaq Lone, Syed Gulzar Ahmed, Abdul Rashid Malik. Manoj Kalsi, Balbir Singh, Parvez Ahmed Bakarwal, Tahir Bakerwal, B Ramakrishna, Raju Kumar Singh, Ajay Saini and Ashok Tak approached him from time to time and allured him that they were having a precious article called Rice Puller (RP), which will benefit him by bringing good fortune and money. The complainant owing to the allurements agreed to the proposal and in the process transferred and paid lakhs of rupees to the accused persons through bank transactions and cash. However, the accused persons after taking the huge sum of money vanished into thin air thereby cheated the complainant of his hard earned money.On the receipt of this complaint, a preliminary verification was initiated in Crime Branch and it was established that the complainant was cheated. Accordingly, a formal case was registered at Police Station Crime Branch, Jammu. During the course of investigation, it came to the fore that Venkata Krishna Modegula was involved in crime and has cheated the complainant and number of other persons by using forged documents. He was arrested from Padma Rao Nagar Hyderabad on 06.05.2016.
Special Municipal Magistrate Jammu M R Chak after hearing Advocate Vishal Goel for the accused wheres as Senior PO MA Almansoor with Inspector Sajjad Pervaz for the state, observe that Bail in non bailable and heinous offences can be denied only when there is apprehension of accused misusing the concession of bail by not being available to face the trial. In the present case, Crime Branch has affected recovery of Rs. 1.00 Crore from the accused and Rs. 2.00 Crores are yet to be recovered from him. He is a non state subject resident of Hyderabad and in case he is admitted to bail at this stage, there is every likelihood of his taking to heels to frustrate the recovery of balance amount. From the case diary, it is manifest that besides this amount, huge amount has been transferred by different persons in his account and in all probabilities, the accused if set free at this stage shall flee leaving the investigating agency in lurch. Even if investigation is otherwise complete, the accused is not entitled to be released on bail keeping in view the fact that Rs. 2.00 Crores are yet to be recovered from him. He has huge assets and can manage the recovery of balance amount but he cannot ask for bail without affecting the recovery of rest of the amount. With these observations Court rejected the bail application.
SSP Crime Branch Jammu Mubassir Latifi said that all the efforts are being made to effect to the arrest of other accused and affect recovery of remaining amount from them and one again appeal to the public at large not to fall pary to tricks of these fradusters.
