ATM fraud; HC transfers FIR to CB

JAMMU: Justice B S Walia of J&K High Court, Jammu, on Tuesday, ordered transfer of ATM theft case to the Crime Branch wing of Jammu and Kashmir Police.
The direction came on a petition filed by M/s Radiant Cash Management Service Pvt. Ltd , a cash management company replenishing cash in various ATMs.
After hearing Advocate KDS Kotwal, appearing for the petitioner and Deputy AG Aseem Sawhney, appear ing for the State, Justice Walia observed that since proper investigation in the matter has not been carried out on nor the accompanying person even questioned, it would be appropriate to refer the matter for investigation to the Crime Branch, Jammu in terms of SRO 202 dated June 3, 1999.
The Court further directed the State to transfer FIR 12/2016 at Police Station Janipur, FIR 15/16 at Police Station, Bakshi Nagar, FIR 8/2016 at Police Station, Akhnoor and FIR 29/2016 at Police Station, Domana to the Crime Branch, Jammu for carrying out investigation and to take appropriate action in the matter, in accordance with law.
Earlier, deficiency of Rs. 69,17,800 had led to the arrest of one of the custodians of ATMs on January 31,2016 but till date no recovery has been effected. Besides in view of the matter being extremely technical, requiring specialised know how of banking procedures, the transfer of cases from Jammu Police to Crime Branch by the petitioner shows displeasure over the investigation of Jammu police.
