ASI awarded one year imprisonment, fine in bribery case

JAMMU: Special Judge Anti-Corruption Srinagar C L Bavoria has awarded one year imprisonment and fine of Rs 10,000 to ASI Mushtaq Ahmad Shah who was caught red-handed by VOK while accepting a bribe of Rs 500 in 2008.
According to VOK (now ACB), accused Mushtaq Ahmad Shah was trapped while he was posted at Police Station Charar-e-Sharief, Budgam on September 19, 2008 after a complaint was lodged by one Ab Rashid Chopan, resident of Fresdub, Charar-e-Sharief, Budgam. It was averred that complainant had purchased 3 quintals of rice from Govt Ration Depot Nagam, Charar-e-Sharief and was transporting the same in a Sumo, but on his way, he was intercepted by ASI Mushtaq Ahmad Shah, posted at Police Station Charar-e-Sharief, Budgam who took him along with rice to Nowhar, Charar-e-Sharief where he demanded and accepted bribe of Rs 500 from complainant but returned only 2 quintals of rice. Accused Mushtaq Ahmad handed over remaining one quintal of rice to a Shopkeeper and demanded further bribe of Rs 1000 from complainant. The complainant persuaded accused, who agreed to accept Rs 500 to settle the issue. The bribe was agreed to be paid on September 19, 2008. However, the complainant lodged a complaint with VOK (now ACB) and accordingly a team of officers arrested the accused public servant ASI Mushtaq Ahmad Shah red-handed while demanding and accepting bribe. The tainted money was also recovered from his possession.
Special Judge Anti-Corruption Srinagar C L Bavoria, after hearing Sajad Ahmad Mir for accused whereas Special Public Prosecutor Ghulam Jeelani for ACB, observed that the accused has misused his official position to gain pecuniary benefit and thus committed an offence of criminal misconduct under section 5(2) d of J&K PC Act. “Prosecution has succeeded in proving charges section 5(2) d of J&K PC Act and under section 161 of RPC against accused and accordingly, this Court convicts accused of the charge and keeping in view the facts and circumstances of case, accused Mushtaq Ahmad Shah is sentenced to undergo simple imprisonment of one year and a fine of Rs. 10,000 (Rupees ten thousands) under each offence. In case of default in payment of fine, the accused shall undergo further imprisonment for one month under each offence,” the Court directed.
