Vigilance Organisation Jammu directed to register FIR against Patwari, others

JAMMU: Special Judge Anticorruption Jammu Sanjay Dhar directed Vigilance Organisation Jammu to file FIR against Patwari and others on the basis of a complaint filed by one Ram Rattan, who had purchased a piece of land and where revenue officers have issued revenue extracts in violation of Agrarian Reforms Act.
In the complaint Ram Rattan had alleged that he had purchased land measuring 2 Kanal and 7 Marla in Khanpur Nagrotra from Rakesh Magotra and further alleged that land in question had been purchased by Rakesh Magotra and his father Nek Ram Magotra from Om Parkash and in turn Om Parkah had acquired the ownwership of the land in question by virtue of mutation attested in his favour under Sections 4 and 8 of Agrarian Reform Act.
According to complainant the revenue officials while issuing Fard Intikhab in respect of land in question at the time of deal on two occasions repeatedly concealed the fact that land had been acquired by Om Parkash under the provisions of Section 4 and 8 of Agrarian Reform Act and further he submitted that now he is being threatened by the successors of Om Parkash of dispossession.
During the course of verification it has revealed that the Fards for first sale deed in respect of the land have been prepared by Shallo Ram and same has been attested by Shanti Saroop then Tehsildar Jammu without obtaining permission from the competent authority.
As per the verification report submitted by VOJ it has come to the fore that revenue officers have issued revenue extracts in violation of Agrarian Reforms Act and VOJ said that the matter is of civil nature as such FIR was not be registered, Special Judge Anticorruption Jammu Sanjay Dhar observed that this Court is not impressed by the submission of the prosecution and it is true that civil litigation between the applicant and the successors of Om Parkash is pending before different for a but is also fact that there is material on record which goes on to show that important facts have been concealed by the revenue officers. With these observations Court directed VOJ to register a case and proceed with the investigation. JNF
