JAMMU: Division Bench of State High Court comprising Chief
Justice M.M Kumar and Justice Tashi Rabstan took serious note
for using Parade play ground for other purpose and directed that
the ground should not be used for any other purpose except for
sport activities. The use of the play ground during Diwali for sale
of crackers is wholly unwarranted and is impermissible. If the play
ground is to be used for any purpose other than the one
pertaining to sports, prior permission from this Court shall be
obtained.
The directions came up after a PIL filed Shambu Nath then Vice
Chairman J and K Cricket Association and Laxmi Cricket Club
Jammu and taken up by Advocate Aparajita Jamwal highlighting
the misuse of Parade Ground for parking and other uses.
Advocate S S Nanda appearing for the Commissioner JMC stated
that the play ground is used for sale of crackers during Diwali for
few days and otherwise, it is maintained as a play ground.
Division Bench directed that in view comprehensive directions
issued by this Court in PIL No. 807/1998 continue to be in
operation and the same shall remain binding on the respondents.
The Division Bench further directed that the play ground should
not be used for any other purpose except sport activities. The use
of the play ground during Diwali for sale of crackers is wholly
unwarranted and is impermissible. If the play ground is to be used
for any purpose other than the one pertaining to sports, prior
permission from this Court shall be obtained. JNF
