Two denied bail in NDPS case

JAMMU: Principal Sessions Judge Jammu Vinod Chatterji Koul rejected the bail application of Kulwant Singh, son of Budha Singh, resident of Gurupura Tehsil Tral District Pulwama, Kashmir and Zahoor Ahmed, son of Jalal Din, resident of Tral District Pulwama, Kashmir who were involved in Narcotic Drugs and Psychotropic Substances (NDPS) Case.
According to police case, while checking a Truck (JK03D-1578) on June 11, 2016 at about 5.50 PM, which was being driven by accused Zahoor Ahmed and was on its way from Narwal Chowk towards Sainik Colony and accused Kulwant Singh was accompanying him, nine bags of poppy straw having 60 kg weight were recovered.
Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing both the sides observed that there is evidence produced by the prosecution regarding the recovery of commercial quantity of poppy straw from the possession of the accused. The trial is still going on and in view of the evidence produced, at this stage it is not permissible to appreciate the evidence in the manner stated by the counsel for the accused. At this stage appreciation of the statement of the prosecution witnesses cannot be done in detail as is done when the case is considered at the final stage after the trial is completed. It is not permissible at this stage to hold as to whether the charge is proved or not and it is only when it can be said that there are reasonable grounds for believing that the accused are not guilty of that offence and that they are not likely to commit the offence while on bail, that an accused of an offence under this Act can be admitted to bail. With these observations Court rejected the bail application.
