JAMMU: In a contempt petition filed by Secretaries of Chief Justice (CJ) and Judges seeking initiation of contempt proceedings against the respondents for non-implementation of judgment passed by the Division Bench whereby Division Bench held that Secretaries of CJ and Judges are entitled to grades equivalent to KAS, a Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan after hearing both the sides directed Chief Secretary, Law Secretary and Finance Secretary to appear in person and State as to why proceedings shall not be initiated against them for non compliance of the order of this Court.
While passing aforesaid direction, the Division Bench observed that the statement of facts have been filed by Secretary to Government, Department of Law and Justice and having regard to the fact that in one of paragraph of Division Bench order clearly stated that the benefit shall be given from the date the petitioners have become eligible and Registrar General also submitted a proposal to that effect, the order of this court is not complied with and directed respondents to appear in person and State as to why proceedings shall not be initiated against them for non compliance of the order of this Court.
