JAMMU: Member Legislative Council (MLC) and Congress leader Sham Lal Bhagat reiterated that any delay in restoring the reservation in promotions by not implementing stay order of Supreme Court can create unrest amongst reserved categories and the situation can go out of control.
“Reserved category employees got stay order from the Supreme Court against High Court judgment in SLP titled Naseeb Singh Vs State of J and K on 18th March 2016 but even after one year of the stay order, the same has not been implemented due to biased bureaucrats misguiding Chief Minister, Law Minister and others,” Bhagat told reporters, here on Saturday. “Almost all the departmental secretaries are continuously promoting employees without giving due representation to reserved categories,” he said adding that this is not only gross injustice to the reserved category employees but also contempt of the highest Court of law in India. He advised the State Government that if they want the welfare of reserved categories, it must adopt 77th, 81st and 85th Constitutional Amendments by Cabinet Memo to negate the High Court order. “The present government came to power on the issues of development of all sections and welfare of disadvantaged sections but during their rule atrocities on SC/STs and other religious minorities have increased,” he reminded.
He said that these sections shall leave no stones unturned to get their due rights.
He stressed upon the government to fill backlog for SC/STs whose representation in government jobs is only 3 per cent and 6 per cent respectively against their set quota of 8 per cent and 10 per cent. In this regard, he said, meeting of Enforcement Board on Monitoring and Implementation of Reservation in J and K should be convened to chalk out ways and means to achieve the result.
