JAMMU: A Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Mohd Yaqoob Mir in a significant judgment directed State to appoint Dr. Shamima as lecturer in Urdu by relaxing upper age limit.
Division Bench after hearing both the sides observed that is entitled to get selection as she has secured 62.36 marks as against the cutoff marks of 54.96 in open merit vacancies.
The writ petitioner being possessed of exceptional qualification, namely, Ph.D, her proposal for age relaxation shall be forwarded by the Public Service Commission to the Government within a period of two weeks from the date of receipt of copy of this order and on receipt of the proposal from the Public Service Commission, the State Government/ Higher Education Department is directed to seek relaxation of upper age from the General Administration Department and on grant of formal order of relaxation of upper age from General Administration Department, the Government shall issue appointment order to the writ petitioner as Lecturer in Urdu.
The entire process is directed to be completed by the Secretary to Government, Higher Education Department and the General Administration Department within a period of 8 weeks from the date of receipt of proposal from the Public Service Commission. JNF
