Pro-freedom speeches by Farooq: HC seeks response from SSP Sgr, SHO Nageen

JAMMU: First Puisne Judge of J&K High Court Justice Ramalingam Sudhakar on Monday directed SSP Srinagar and SHO Nageen to submit response in the writ petition filed by social activist Sukesh C. Khajuria seeking registration of FIR against Dr. Farooq Abdullah former Chief Minister J&K and President J&K National Conference for his pro-freedom speeches made on December 5, 2016 at Naseem Bagh (Hazratbal) Srinagar and at Nawa-e-Subh, Headquarter of National Conference at Srinagar on February 24, 2017, by or before the next date of hearing i.e. December 21, 2017.
When this petition came up for hearing Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina and Supriya Chouhan drew the attention of the court towards the latest Miscellaneous Petition filed by the petitioner Sukesh C. Khajuria wherein he is seeking directions to the SSP Srinagar and SHO Police Station, Nageen to place before the High Court the latest status of the enquiry particularly after the recording of the petitioner’s statement at Police Station, Nageen (Srinagar) on September 5, 2017.
Advocate Ahmed submitted that despite the fact the statement of the petitioner Sukesh C. Khajuria has been recorded by the SHO Police Station, Nageen but till date there is no headway into the preliminary enquiry initiated on the complaint of the petitioner. Advocate Ahmed further submitted that as per the law laid down by the Apex Court, the SHO was under an obligation to complete the preliminary enquiry within 15 days but till date neither the enquiry has been finalised nor the SSP Srinagar and SHO Nageen have filed response to the writ petition.
Advocate S. S. Ahmed further submitted that as per Criminal Procedure Code the complaint was to be lodged by the District Magistrate Srinagar to the Police but in view of the strong clout of the former CM, the District Magistrate Srinagar preferred to maintain criminal silence and it is only the petitioner who has been moving from pillar to post to make the criminal justice system run as the State lacks the will to prosecute the former CM of the State.
Advocate Ahmed submitted that there is casual approach of the State government as despite service of notices nobody is present on behalf of the State government and this shows the non-serious attitude of the state government in a petition of wide public importance.
