Police interference in civil dispute: Court asks SSP Kathua to comply orders

JAMMU: Chief Judicial Magistrate (CJM) Kathua Amarjeet Singh Langeh on Monday directed SSP Kathua to ensure compliance of order dated 4th January in the matter of alleged interference of police in civil dispute or remain present in the aforesaid court on next date of hearing to give account of defiance. Earlier on 4th January, while considering the case of alleged interference of police in civil dispute, CJM Kathua has ordered that Police must guard itself against this tendency. In this regard, an application was filed for issuing rule of court against Ajay Sharma Dy. SP Headquarter, Kathua and Sarabjeet Singh, SHO Police Station, Kathua.
CJM Kathua after hearing both the sides observed that once matter was brought to the notice of Senior Superintendent of Police (SSP), Kathua, he ought to have gauged the gravity of alleged lapse on the part of his sub-ordinate officials, the respondents herein and ensured compliance of the order sought to be implemented. “Same has not been done. Instead, by not being able to implement order in question respondents are only giving an impression of studiously avoiding compliance of court order. It is to be noted that compliance of court orders is one of the core functions of police and not an extension of courtesy. All this should not have happened under the very noose of district head of law enforcing agency”, the court observed.
“Aforesaid circumstances make it imperative that a direction be issued to Senior Superintendent of Police, Kathua to implement/cause to be implemented order dated 4th January 2017 in letter and spirit and file compliance report by or before next date of hearing.
Should he fail to do the needful as directed, in that eventuality, he shall appear in person on next date of hearing to give an account of said failure so that matter can be dealt with accordingly in line with mandate of law on the subject”, he oberved.
