PK hails SC’s decree on SARFAESI Act, seeks repealing of Art 370

JAMMU: Panun Kashmir on Wednesday hailed the 16th December judgment of Supreme Court of India that upheld the applicability of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interests (SARFAESI) Act to Jammu and Kashmir.
Addressing a press conference, Chairman Panun Kashmir Ajay Chrungoo said that the SC judgment has for once and all put all controversies arising out of the claims of separatists in the state and Pakistan with regard to constitutional relationship between State and Union of India to rest.
The Supreme Court judgment has reiterated the most fundamental fact that J&K is an integral part of India and that the provisions of Article 370 embodied in the Constitution of India doesn’t in any respect recognize it as a separate entity. The Supreme Court judgment has made it clear that Constitution of Jammu and Kashmir is subordinate to Constitution of India as the Constitution of India is the only one expression of the authority of Indian State. “It should be clear to every person in Jammu and Kashmir and rest of India as well as outside India that the State of India is indivisible and its territorial and political character is inviolable”, the judgment reads.
“Panun Kashmir condemns all attempts that describe the reiteration of the constitutional reality of the state by the Supreme Court of India as a judicial route to undermine Article 370 and Article 35-A. Such political forces have all through sought to wreck the State from within by undermining and violating the constitution”, Chrungoo said.
“Panun Kashmir demands that now that the Supreme Court of India has defined in unambiguous terms the political status of Jammu and Kashmir, as also the political status of its citizens vis a vis rest of fellow Indians, it is the most appropriate time to repeal Article 370 lock stock and barrel. Its repeal will fulfill the 67 years old dream of the Indian nation that Jammu and Kashmir shall be completely integrated into India politically, constitutionally and economically”, he maintained adding that PK also reiterate that Jammu and Kashmir should be quadric-partitioned with creation of the Union Territory of Panun Kashmir north and east of river Jhelum in the province of Kashmir for the rehabilitation of exiled Hindus of Kashmir for the permanent reversal of the genocide inflicted on them.
