JAMMU: Presiding Officer Fast Track Court Kishore Kumar Monday awarded rigorous imprisonment for one year and a fine of Rs. 25,000/- under section 354 RPC to one Anil Singh who was facing trial in attempt to rape of six years old girl.
According to the police case that on 19.01.2008 father of the victim lodged a report inter-alia ,alleging that on 15.01.2008 inhabitants of the Mohalla had gathered in a marriage function in the neighborhood, Anil Singh, had taken his daughter (victim) aged 6 years from the said place to a nearby room and committed rape on her and while he was trying to kill her by strangulating her, she had become unconscious and after hearing the noise of people, he had fled from the spot, the victim regained conscious after three hours and even the victim had urinated and passed stool during the process. On the basis of this report an FIR No. 05/2008 for commission offences under sections 376, 511 RPC was registered and investigation of the case was entrusted to SI Karan Chalotra, Incharge Police Post, Sainik Colony, Jammu and after investigation of the case, challan came to be presented against him.
Presiding Officer Fast Track Court Kishore Kumar after hearing both the sides observed that the case coupled with the submissions made by the convict, Court is of the considered opinion that the ends of justice can be met by sentencing convict , to undergo rigorous imprisonment for one year and a fine of Rs. 25,000/- under section 354 RPC. In default, the convict shall undergo simple imprisonment for three months. It is also made clear that in case fine amount is realized from the convict, then an amount of Rs. 20,000/- shall be paid to the prosecutrix as compensation who had suffered due to the act of the convict.
