NIA files charge-sheet against Naveed, 5 others

JAMMU: More than five months after two Pakistan based Lashkar-e-Toiba (LeT) militants mounted an audacious strike on BSF convoy near Narsoo nullah along the Jammu-Srinagar National Highway on August 5, 2015 in Udhampur district, the National Investigation Agency (NIA), probing the terror attack case, on Thursday produced challan in the Court of Special Judge NIA against nine accused including lone terrorist Mohd Naveed, captured alive from the encounter site.
The challan was produced against Mohammad Naveed alias Usman, son of Mohammad Yaqoob (20), resident of Street No 3, Rafiq Colony Kookiyanwal, Pakistan, Ghulam Mohammad Abad, Khursheed Ahmed Bhat, son of Gulam Mohammed Bhat, resident of Bhatpora, Chursoo, Awantipora, Pulwama, Showkat Ahmed Bhat, son of Ali Mohd Bhat, resident of village Khardermuh, District Pulwama, J&K and Shabzar Ahmed Bhat, son of Abdul Rashid Bhat, resident of Nai Basti, Gulshan Abad, Quimoh, Police Station, Kulgam, District Kulgam, Khursheed Ahmed Ittoo and Fayaz Ahmed Ittoo alias Foyaz alias Fayaz whereas two other accused who are absconding are Fayaz Ahmed Ashwar alias Setha and Ashiq Hussain Bhat alias Ubaida.
The challan is about 1600 pages in which about 200 witnesses included 19 protected witnesses were cited.
In the challan, it has been submitted that the challan was not produced against Abu Noman, a Pakistani neutralised by the security forces during encounter at Udhampur.
According to the challan, the case relates to a terrorist attack on a BSF convoy by Pakistani terrorists belonging to LeT on Srinagar-Jammu National Highway near Narsoo Nallah, village Narsoo District Udhampur.
NIA team worked hard over a period of five long months to piece together the complete conspiracy.
According to the challan, the terrorist strike on the BSF convoy was the culmination of an overarching conspiracy entered into by various entities linked to the LeT, a proscribed terrorist organization.
The investigating agency has also established that the specific conspiracy culminating in the terrorist attack on BFS convoy in District Udhampur was a part of a larger conspiracy to wage war against the Govt of India by the LeT, through its agents and it is as part of overarching conspiracy that terrorists are recruited and trained in Pakistan and POK by the LeT and then infiltrated into India to commit terrorist attack.
The ends of the conspiracy are further complimented by networks of local terrorist, facilitators and supporters who provide a variety of logistic support to the terrorists once they enter India Territory.
The chargesheet has been filed under Sections 120B, 121, 121A, 122, 302, 307, 325, 326, 333, 342, 364, 435, 109 & 34 of the Ranbir Penal Code, Sections 16, 18, 19, 20, 38 & 39 of the Unlawful Activities (Prevention) Act, Section 14-A Foreigners’ Act, Section 3 (3) of the Passport (Entry into India) Act, Section 25 (1) (A), 25 (1-B) (a) and Section 27 of the Arms Act, Section 9- B (1) (a) (b) of the Explosive Act, and Section 3 (b) & 4 of the Explosive Substances Act.
According to official sources, Special PP Baldev Singh Manhas with Chief Investigating Officer Atul Goel presented challan.
Special Judge NIA Kishore Kumar observed that since the powers under NIA Act has not been entrusted, so the effective order cannot be passed and FIXED February 12, 2016 for further proceedings and sent the accused back to Jail.
While NIA team presented the challan, some of the accused requested before the Court that NIA is not allowing them to meet with their relatives in the Court, upon this Special Judge NIA said that this direction was passed by the High Court and if their relatives wants to meet with them they will go to Jail and met them under Jail Manual.
