Murderous assault by Nalwa at Sabzi Mandi Narwal HC stays proceedings against Inspector Chanchal

JAMMU: Justice Tashi Rabstan of J and K High Court Jammu Wing issued notice returnable within four weeks and in the meanwhile ordered that subject to objections from other side and till next date before the Bench, proceedings before Trial Court in case Ranjodh Singh verses Inspector Chanchal Singh and another shall remain stayed.
The direction came in response to a petition filed by Inspector Chanchal Singh and others for quashing the complaint filed by Ranjodh Singh alias Nalwa against them before Sub-Judge Court Jammu whereby cognizance of offence under Sections 341, 325 and 506 RPC has been taken by the Trial Court and process has been issued.
Advocate P.S Parmar appearing for the petitioners has submitted that petitioner Chanchal Singh was serving as SHO Bahu Fort and Inayat Ali SI was posted as Incharge Police Post Narwal during April, 2014 and on April 15, 2014 respondent Ranjodh Singh along with few other persons attempted a murderous attack on one Surinder Singh alias Kala at Sabzi Mandi Narwal where a scuffle took place between Surinder Singh and others. Due to hue and cry, the police personnel deputed on duty caught hold of three accused including Ranjodh Singh and FIR No. 78/2014 was registered under Sections 307, 452, 382, 147, 148 and 323 RPC and 4/25 Arms Act and respondent was arrested. The respondent was released after grant of bail by the Court and later District Magistrate Jammu ordered detention of respondent Ranjodh Singh alias Nalwa under Public Safety Act (PSA) and after some time the respondent filed a complaint against the petitioners that he was illegally detained by the petitioner on 15th April, 2014 without mentioning the FIR.
