JAMMU: First Additional Sessions Judge Jammu M.A Chowdhary rejected the bail application of one Ranjit Singh who was facing trial in murder case.
According to the case that on 5th September, 2011 during a party organised by one Sikander Singh after his father Shamsher Singh’s victory in elections for sarpanch, on the bank of river Chenab, accused had caused repeated serious injuries on the chest of one Surinder Kumar alias Shinda, resident of Akhnoor who later succumbed. On the interrogation of the accused had made disclosure and got recovered the weapon of offence a kirch. Prosecution said that one Channi Manhas sodomized by co-accused Rakesh Kumar and Sham Singh and the deceased Surinder Kumar alias Shinda also attempted to commit the crime and in the meanwhile, the petitioner made a murderous assault on Surinder Kumar alias Shinda.
1st Additional Sessions Judge Jammu M.A Chowdhary after hearing Advocate D.S Saini for the petitioner whereas APP Ajay Singh Manhas appearing for the State observed that grant of bail to the accused will provide him an opportunity of tampering with evidence. Though the case in hand is five years old but the prosecution has examined most of the witnesses in this case and even one witness has been examined on last date also. Petitioner/accused has sole plea of turning hostile of the eye witnesses and no other ground has been urged. It will not be in the interest of justice to allow this application for grant of bail to the petitioner/accused who has been charged of murder, as this Court has no circumstance to take a view that the accused has not committed murder. With these observations court rejected the bail application.
