Husband, mother-in-law acquitted in dowry death case

JAMMU: Principal Sessions Judge, Kathua, Vinod Chatterji Koul has acquitted one Vijay Kumar and his mother Soma Devi who were facing trial in dowry death case, as prosecution failed to prove the case.
According to police, on 17th July, 2009, information was received that one woman, Sunita Kumari, wife of Vijay Kumar, resident of Hiranagar, has suffered burn injuries and has been admitted to GMC, Jammu, where she succumbed to burns, During investigation, it was found that her death appears to be suspicious and proceedings under Section 174 CrPC were initiated and officers were informed. During inquiry, Manwar Hussain, Sub Inspector, inspected the spot of incident, conducted an inquiry, recorded the statements of witnesses and also obtained the report of post-mortem.
After conducting inquiry, police found that deceased was beaten by her husband and mother-in-law on the ground that she has failed to give birth to a child and was used to turn her out of the house. Because of the behaviour of the accused, she was forced to commit suicide. After completion of investigation a challan was presented.
After hearing both sides, Principal Sessions Judge Kathua Vinod Chatterji Koul observed that prosecution has failed to prove that the deceased committed suicide and the suicide was abetted by the accused and as such, charges framed against the accused are not to be proved beyond any doubt, accordingly the challan failed and the same is dismissed.
