HC upholds PSA of OGW JeM

JAMMU: Justice Sanjay Dhar of Jammu & Kashmir and Ladakh High Court upheld the detention under PSA of Kifayat Rashid Bhat an over ground worker of banned terrorist organization Jash-e-Mohammad.
Justice Sanjay Dhar while uphold the order No.88/DMP/PSA/22 dated December 9, 2022, issued by District Magistrate, Pulwama (for brevity “Detaining Authority”) in which Kifayat Rashid Bhat (for short “the detenue”) has been placed under preventive detention and lodged in Central Jail, Kotbhalwal, Jammu, observed that a perusal of the grounds of detention reveals that it has been clearly mentioned that the petitioner was in touch with one Owais Feroz alias Owais, resident of Pampore, who motivated him to work for the terrorist outfits.
It is also indicated in the grounds of detention that the petitioner was getting text messages from the aforenamed person from an unknown number in September, 2022.
The grounds of detention further reveal that the petitioner is an active over ground worker of banned terrorist organization Jash-e-Mohammad. Thus, there are specific allegations and assertions made in the grounds of detention. Therefore, it cannot be stated that the allegations made in the grounds of detention are vague or lacking in material particulars.
The fact that the petitioner made a representation, which seems to be an effective representation against the impugned order of detention, clearly shows that he has not been hampered from making a representation on account of alleged lack of specific particulars in the grounds of detention. The contention of learned counsel for the petitioner in this regard is, therefore, without any merit.
