HC upholds detention of sympathizer of terrorists

JAMMU: Justice Sanjay Dhar of Jammu & Kashmir and Ladakh High Court Srinagar Wing upheld PSA of one Mohd Rafiq Nazar, who is a sympathizer of terrorists, and provides food and shelter to them.
Justice Sanjay Dhar, after hearing both sides, observed that a perusal of the grounds of detention, particularly para 3 thereof, revealed that there is an allegation that petitioner used to provide food and logistic support to the terrorists of banned organization JeM especially Mufti Altaf of Nethipora Dooru besides assisting in transportation of weapons. The identity of the terrorist, to whom petitioner is alleged to have provided food, shelter and logistic support for transportation of weapons, was mentioned as grounds of detention. Therefore, it is not a case where necessary particulars required for making an effective representation against detention order are lacking grounds.
Justice Sanjay Dhar, while dismissing the petition, observed that the detention record that has been produced by counsel for respondents for perusal of Court, revealed that petitioner has been provided 10 leaves. “Execution report contains signature of the petitioner along with signature of Executing Officer. The material forming basis of impugned order of detention includes grounds of detention and police dossier. Besides this, the other documents which are available in detention record include impugned order of detention and notice of detention. Therefore, it cannot be stated that the petitioner has not been provided with whole material that has formed the basis of impugned order of detention. The ground urged by the counsel for the petitioner in this regard is without any merit and deserves to be rejected,” the Court observed.
