HC stays proceedings against Shabir Khan

JAMMU: Justice Bansi Lal Bhat of J and K High Court Jammu Wing on Tuesday stayed the proceedings before the CJM Srinagar against the then MOS Health Shabir Khan in molestation case.
This significant order has been passed in a transfer application filed by Shabir Ahmed Khan, the then MOS Health.
While staying the proceedings, Justice Bansi Lal Bhat after hearing senior Advocate Sunil Sethi with Advocate Ravi Abrol appearing for the petitioner, observed that petitioner who served as Minister of State in previous cabinet and is facing trial before the CJM Srinagar for the offence under Sections 354 and 509 RPC and seeking transfer of the case from the Court of CJM Srinagar on the ground that he was feeling insecure as he no more enjoys security cover and that the media has started a campaign to generate public opinion against him at the instance of some separatists forces and it is contended that fair trail is not possible at Srinagar in the vitiated atmosphere and the case deserves to be  transferred to a court at Jammu so as to ensure a fair trial.
Justice Bansi Lal Bhat issued notice returnable within two weeks and directed CJM Srinagar to send the comments and directed that meanwhile CJM shall not proceed further with the trial till next date. JNF
