HC stays probe in FIR against EO Udhampur

JAMMU: Justice Janak Raj Kotwal ordered stay on investigation in FIR No. 21/2017 and issued notices to respondents in petition filed by Ravi Kumar Executive Officer Udhampur seeking quashment of aforesaid FIR registered by Vigilance Organisation Jammu (VOJ) against him and others.
Justice Kotwal after hearing Advocates A.P Singh and Ajay Bakshi also ordered that objections be filed before next date of hearing till then probe in the aforesaid FIR shall remain stayed.
According to the VOJ a case under Section 5(1) (d) read with 5(2) J&K PC Act and Section 120-B RPC was registered against Ravi Kumar the then Executive Officer, Municipal Council Udhampur and the beneficiaries namely Neeraj Gupta and Dheeraj Gupta, both sons of Rattan Bushan, residents of Ward No. 2 near Ram Leela Ground Adarsh Colony Udhampur on the basis of a verification conducted into the allegations that Neeraj Gupta and Dheeraj Gupta had made constructions in violation of building permission/sanctioned plan. Verification has revealed that residential building permission vide Order No. MCU/2011-12/1202 dated 28th September 2011 was issued by then Executive Officer in favour of the above mentioned beneficiaries with permission to cover 3189.5 Sq ft. at ground floor and 2582 Sq ft. at first floor. However, the applicant has covered 95 per cent of the plot area as per site plan. The verification revealed that the beneficiaries in league with the accused officers/officials of Municipal Council Udhampur and in utter violation of approved plan constructed 4835.5 Sq ft. more than the approved plan. It has further revealed that in order to cover-up the violations and to provide sufficient time to the beneficiaries to raise the aforesaid construction a mere formality of issuing notice under section 7(1) has been conducted, but no action as warranted under section 7(3) of Municipal Act has been under taken.
