HC issues contempt notices to VC CUJ, Registrar, others; seeks compliance report

University Asst Professor alleges harassment, violation of Court Order

JAMMU: Justice Dheeraj Singh Thakur of J&K High Court has issued contempt notices to Prof Ashok Aima, Vice Chancellor Central University Jammu, Jit Singh,Registrar, Central University of Jammu, Prof. Devanand Head of the Department of Computer Sciences and IT Central University of Jammu and directed the said respondents to file compliance report of the High Court Order dated 30.12.2015.
This Order was passed by the Court in a contempt petition filed by Dr. Namita Singh, Assistant Professor in the Department of Computer Sciences and IT through Advocate Aseem Sawhney.
Sawhney submitted that petitioner was working on contractual basis and filed a writ petition wherein on 30/12/2015 the High Court was pleased to issue notice to the respondents and directed that the petitioner shall not be replaced by others contractual employee.
Sawhney submitted that the respondents did not assign faculty, administrative or any other work to the petitioner as per previous routine. This compelled the petitioner to approach this High Court again by means of writ petition SWP 31/2016 titled Prof. Namita Singh V/s Central University of Jammu and others on 14/1/2016 when the matter came up and the respondents were on caveat it was brought into the notice of the Court that the respondents have issued the time table dated 14/ 1/ 2016 and petitioner was assigned the classes/ work.
Counsel for the petitioner Dr Namita Singh further contended that the petitioner continued and is continuing to work and attend the University work but suddenly a new time table was issued by the respondent number 3 whereby the petitioner’s name did not figure in the new time table and subject of the petitioner was assigned to one Mr. Ram ji who is the Technical Assistant. This again compelled the petitioner to file another writ petition number SWP 470/2016 titled Dr Namita Singh V/s Central University of Jammu and others whereby the petitioner challenged this impugned time table (with effect from 4/ 3/ 2016).On 14/3/2016 when the matter was listed before the Court the counsel for the respondent- University placed on record a copy of a circular dated 8/ 3/2016 issued by respondent number 3 whereby the impugned time table dated 4/3/ 2016 stood withdrawn. Therefore in light of the impugned time table being withdrawn the petitioner had no grouse and therefore withdrew the writ petition.
In the order dated 30/12/2015 had directed that the petitioner not be replaced by any contractual employee and in deference to this order the petitioner had continued and was continuing till date.
He submitted before the Court that just to hoodwink and play foul the respondents have started the exercise aimed to flout the Court order and harass the petitioner. The petitioner has not been assigned any classes and any faculty, administrative or any other work by the respondents and a policy of social and administrative apathy is being pursued by the respondents.
He further alleged so much so that now the respondents have started intimidating the petitioner by sending male security officials of the University threatening the petitioner to desist come to the University. In this connection the petitioner has written several times to the respondents but all in vain because the respondents are bent upon to flout the orders of the Court and over reach the High Court which tantamounts to contempt and polluting the stream of administration of justice system. The respondents are unfair and are harassing and humiliating the petitioner just to ensure that she withdraws her writ petition filed against the respondents and succumbs to the pressure.
On hearing these submissions of Aseem Sawhney counsel for the petitioner Dr Namita Singh , the High Court issued notice to the respondents and directed for compliance report.
