JAMMU: Justice Alok Aradhe of J&K High Court granted bail to Jatinder Singh, son of Ex-Major Harnam Singh, resident of Sainik Colony Jammu, Sanjay Kumar, son of Gopal Dass, resident of Akhnoor, Jammu and Swarna Kumari, wife of Ashok Kumar, resident of Qasim Nagar, Narwal, Jammu who were involved in much publicised Channi Himmat Gang Rape case.
According to the police, prosecutrix on 26th September 2016 filed a written report inter-alia alleging that she is a student of Jammu University and putting up at Qasim Nagar, Jammu on rent basis. “During the intervening night of 25/26th of September 2016, one lady Swarna Devi, wife of Ashok Kumar took the prosecutrix to her room located at Channi Rama, Jammu where three persons namely Sanjay, Jatinder and Bubby raped her. After the commission of offence, all the accused persons fled away from the spot after locking the prosecutrix in a room. On the next day, prosecutrix managed to open the door and thereafter she filed the complaint. On this report, FIR No. 94/2016 for the commission of offences under sections 376 and 120-B RPC was registered and the investigation commenced.
Justice Alok Aradhe after hearing both the sides in length observed that it is not in dispute that the petitioners are in jail for the last more than five months and the investigation has been completed and charge-sheet has been filed. There appears to be no need of their custodial interrogation and granted bail with the direction that the petitioners shall remain present before the trial court on each and every date of hearing and they shall furnish personal bond in the amount of Rs. 50,000 with one surety of like amount each to the satisfaction of Registrar Judicial of this Court and they shall not directly or indirectly make any inducement either to intimidate or try to influence the witnesses in any manner and also they shall not leave the State without prior permission of the trial court.
